In an opinion issued June 29, 2017, the Third Circuit Court of Appeals concluded that Judge Salas, in the District Court for New Jersey, appropriately granted approval to a class action settlement for diminution in property values resulting from chromium contamination. The Court, rejecting arguments made by an objector, found that the District Court had soundly exercised its discretion in granting final approval and in awarding attorney fees to class counsel as a percentage of the fund. The Third Circuit remanded the decision in part, requesting additional reasoning from the District Court related to the portion of its opinion approving an award of litigation costs, some of which the objector argued were comingled and should not have been awarded where only one of two defendants had settled.
