Kanner & Whiteley, L.L.C., along with the Conservation Law Foundation (“CLF”), has issued notices of intent to sue several fuel storage terminals situated on the banks of New Haven Harbor under the federal Clean Water Act (“CWA”) and the Resource Conservation and Recovery Act (“RCRA”). The terminals sit in flood-prone areas and are unprepared for the severe weather the climate crisis is already inflicting on the area. The notice letters seek to enforce the requirements of the CWA and the associated stormwater permitting provisions, as well as RCRA, which require that such facilities consider and guard against the increased and foreseeable risks of severe weather events. The notice letters were issued to Gulf, Magellan, and Shell and can be viewed here. The firm has previously sued ExxonMobil and Shell for similar violations at their terminals in Massachusetts and Rhode Island, respectively.
