Deepwater Horizon Trial Enters Phase II

New Orleans law firm Kanner & Whiteley, LLC is proud to represent Attorney General James “Buddy” Caldwell in the Deepwater Horizon Spill Litigation, MDL No. 2179.

On September 30, 2013, Phase II of the trial focused on Deepwater Horizon and the resulting personal, economic and environmental injuries commenced before the Honorable Judge Carl Barbier in the United States District Court for the Eastern District of Louisiana.

The first week of trial focused on the Source Control portion, which primarily involved the plaintiffs’ allegations against BP that it was inadequately prepared to respond to a foreseeable deepwater blowout in the Gulf of Mexico. Additionally, it addressed allegations that BP’s misrepresentations to the United States Government led to a delay in the capping of the well, which allowed millions of barrels of oil to flow into the Gulf of Mexico over 87 days.

The Quantification portion of the trial will commence on Monday, October 7 and continue until Thursday, October 24. This portion of the trial will attempt to determine the number of barrels of oil that flowed into the Gulf as part of the United States’ Government’s Clean Water Act claims against BP.
