Mr. Kanner’s article, More than Seals and Sea Otters: OPA Causation and Moratorium Damages, 28 Duke Envtl. L. & Pol’y F. 31-72 (2017), was published this month with the Duke Environmental Law & Policy forum. It addresses the Fifth Circuit’s handling of the BP Moratorium claims following the Deepwater Horizon disaster. Mr. Kanner argues that the Court’s narrow interpretation of the Oil Pollution Act resulted in an erroneous denial of recovery to many claimants. You can read the article here.
