David A. Pote

David joined K&W in 2010. His practice focuses on environmental and toxic torts, natural resources damages, and consumer fraud. Most notably, David is an active member of the K&W litigation team representing the State of Louisiana in the BP Deepwater Horizon oil spill disaster. As Special Counsel to the Louisiana Attorney General in the Federal multi-district litigation for the BP spill, David and the rest of the K&W team play a crucial role in what is arguably the largest civil litigation in U.S. history, as Louisiana’s claims already easily exceed half a billion in damages.

Prior to joining K&W, David spent nearly a decade litigating with the Birmingham, Alabama law firm of Lloyd, Gray, Whitehead and Monroe, specializing in the defense of large workers’ compensation claims, as well as in the areas of insurance defense, insurance coverage and medical malpractice. While his practice with Lloyd, Gray was centered in Alabama, David also litigated for the firm in Florida, handling various matters, including a multi-million dollar negligent appraisal case involving a large Florida beach condominium complex. David’s work at Lloyd, Gray included representation of clients before the Alabama Supreme Court and Federal district courts.

David earned his J.D. from Tulane Law School in 2000. While at Tulane, David was an active member of the Moot Court Board. During his second year, he placed second amongst 65 individual participants in the Chaffe, McCall, Phillips, Toler & Sarpy 1998 Junior Appellate Tournament. He went on to serve as Senior Appellate Justice for the Tulane Moot Court Board.

David is a member of the State Bars of Louisiana, Florida and Alabama, as well as numerous professional organizations. He is also admitted to practice in the United States Fifth Circuit Court of Appeals, as well as the United States District Courts for the Eastern District of Louisiana and the Northern and Southern Districts of Alabama.
