The Tenth Circuit Court of Appeals affirmed the trial court’s finding that the defendant Cox Communications had waived its right to compel arbitration.

On June 24, 2015, the Tenth Circuit Court of Appeals affirmed the trial court’s finding that the defendant Cox Communications had waived its right to compel arbitration. This ruling came in Healy v. Cox Communications, the bellweather case in the Cox MDL pending in the Western District of Oklahoma that was heading to trial prior to Cox’s belated assertion of an arbitration claim.
