This January, Judge Robin Cauthron of the United States District Court for the Western District of Oklahoma has granted a motion for class certification in the multi-district litigation proceeding re: Cox Enterprises, Inc. Set-Top Cable Television Box Antitrust Litigation. The Class is represented by New Orleans law firm Kanner & Whiteley and its co-lead counsel.
This multi-district litigation is a consolidation of various suits filed in 2009 by a number of Cox subscribers alleging that the cable company illegally forced subscribers to rent a Cox set-top box in order to have access to all of Cox’s cable services in violation of federal antitrust law.
The Oklahoma City geographic market class action, Healy v. Cox Communications, was selected by counsel as a test case to proceed first and in early November 2013, the plaintiff moved to certify this case. After a two-day hearing, the Court granted the motion on January 9, 2014, concluding that the Oklahoma City case could proceed as a class action to resolve the alleged antitrust violations associated with Cox’s set-top box rental requirement.
